Financial Promotions can play an important role in the financial decisions made by consumers, who may be influenced by the substance and presentation of them. They can significantly impact whether they decide to engage with a particular financial or cryptoasset service provider, or use a particular financial or cryptoasset product.

As such, Financial Promotions play a key role in the FCA’s overall aim of delivering an efficient and effective market in financial and cryptoasset services, and in helping customers achieve a fair outcome. The FCA defines the retail customer as an individual who is acting for purposes which are outside his or her trade, business, or profession.

Financial Promotions in cryptoassets were brought by the FCA into the regulatory perimeter where financial promotion regime applies. The following are the main (though not exhaustive) areas of legislation and regulation that impact the scope:
